El Non Bis In Ídem en el Caso Sharon y las decisiones de la Administración de Justicia Penal

Abstract

El presente trabajo de investigación contiene un análisis y estudio de la normativa penal que se encarga de regular la conducta machista y misógina de los hombres contra las mujeres, presentado por el delito de femicidio, que se encuentra tipificado en el artículo 141 del Código Orgánico Integral Penal, haciendo un análisis de un caso de femicidio que causó un gran impacto social en Ecuador, el caso Edith Bermeo “Sharon”, el cual presentó vacíos en su proceso y por ende en su sentencia. Además, se verificará la posible vulneración del principio constitucional de Non Bis In Ídem, en contra del acusado, el señor Geovanny López Tello y demás inconsistencias presentadas en este caso. Finalmente, se realizarán encuestas a conocedores, estudiantes y profesionales del derecho que darán a conocer su criterio sobre la norma penal y por supuesto, del caso presentado. Así también, se definirán conclusiones y recomendaciones que aporten a esta investigación.

This research work contains an analysis and study of the criminal law that is responsible for regulating the sexist and misogynistic behavior of men against women, presented for the crime of femicide, which is typified in article 141 of the Comprehensive Organic Code. Penal, making an analysis of a femicide case that caused a great social impact in Ecuador, the Edith Bermeo "Sharon" case, which presented gaps in its process and therefore in its sentence. In addition, the possible violation of the constitutional principle of non bis in idem, against the defendant, Mr. Geovanny López Tello, and other inconsistencies presented in this case will be verified. Finally, surveys will be carried out among connoisseurs, students and legal professionals who will reveal their opinion on the criminal law and, of course, on the case presented. Also, conclusions and recommendations that contribute to this research will be defined.
