Error de tipo y error de prohibición en el uso progresivo de la fuerza

Abstract

Al momento de llevar a cabo sus labores, los policías, militares y agentes de seguridad penitenciaria, se encuentran en situaciones que, por su complejidad, exigen por parte de ellos una actuación rápida. Entre los medios con los que cuentan los agentes de seguridad pública, para el cumplimiento de su deber constitucional, está el uso de la fuerza. Producto de las circunstancias apremiantes, la actuación del servidor público encargado de seguridad puede no ser la más idónea, esto debido a factores como la falta representación de los hechos que suceden a su alrededor o las circunstancias que excluyen lo antijuridico de su actuar. El presente trabajo investigativo tiene como fin explorar estas circunstancias. Nuestra investigación de carácter cualitativo, mediante la recopilación de información y la aplicación de entrevistas nos permitió obtener la suficiente solvencia académica para presentar una propuesta con respecto al uso progresivo de la fuerza y posible existencia del error de tipo y prohibición.

At the time of conducting their work, the police, military and prison security agents find themselves in situations that, due to their complexity, require rapid action on their behalf. Among the means available to public security agents, for the fulfillment of their constitutional duty is the use of force. As a result of the pressing circumstances, the action of the public servant in charge of public safety may not be the most suitable, this may be due to factors such as the lack of knowledge of the facts that happen around him or the circumstances that exclude the antijuridic of his action. The present research work aims to explore these circumstances. Our qualitative research, through the collection of information and the application of interviews allowed us to obtain sufficient academic solvency to present a proposal regarding the progressive use of force and existence of the error of type and ban.
