Estudio de la incidencia de las citaciones en materia no penal y cómo afectan al principio de celeridad en Ecuador

Abstract

Nuestro trabajo de investigación se centra en la diligencia de citación y en como su cumplimento tardío afecta al principio de celeridad consagrado en la Constitución. El objetivo general de este trabajo de investigación es entregar un documento a la Asamblea Nacional y al Pleno del Consejo de la Judicatura con las sugerencias pertinentes para que la realización de la diligencia de citación garantice plenamente el principio de celeridad. La metodología utilizada fue la investigación mixta ya que a través del análisis de expedientes y de las entrevistas realizadas pudimos recabar datos estadísticos y subjetivos que nos brindaron resultados veraces que atienden a la realidad que gira en torno a la citación. Los resultados obtenidos fueron que la diligencia de citación sufre retardos principalmente por la falta de recursos económicos en esta área y por la información incorrecta o insuficiente que facilita el actor en el libelo de su demanda.

Our research work focuses on the summons diligence and how its late compliance affects the principle of speed enshrined in the Constitution. The general objective of this research work is to deliver a document to the National Assembly and the Plenary of the Council of the Judiciary with the pertinent suggestions so that the performance of the summons diligence fully guarantees the principle of speed. The methodology used was the mixed investigation since through the analysis of files and the interviews carried out, we were able to collect statistical and subjective data that gave us truthful results that attend to the reality that revolves around the citation. The results obtained were that the summons diligence suffers delays mainly due to the lack of economic resources in this area and due to the incorrect or insufficient information provided by the actor in the libel of his claim.
