La suspensión condicional de la pena como medida alternativa de privación de libertad en la Ciudad de Guayaquil

Abstract

La suspensión condicional de la pena es un mecanismo mediante el cual el sentenciado se beneficia de la norma, recuperando su libertad siempre y cuando cumpla con los requisitos y condiciones establecidas. Con la finalidad de analizar la importancia de la suspensión condicional de la pena como medio alternativo a la pena privativa de libertad en la ciudad de Guayaquil, en la reducción del hacinamiento carcelario, se llevó a cabo una investigación que propone destacar el rol que representa este mecanismo en la mitigación de los problemas del sistema carcelario del país y en la eliminación del circulo de violencia y criminalidad. Entre los resultados de esta investigación se identificó la importancia de la inclusión de la suspensión condicional de la pena en procedimientos de segunda instancia en la reducción del hacinamiento, protección de los derechos constitucionales de las personas privadas de libertad y la reparación integral de las víctimas.

The conditional suspension of the sentence is a mechanism through which the sentenced person benefits from the norm, recovering his freedom as long as he complies with the established requirements and conditions. In order to analyze the importance of the conditional suspension of the sentence as an alternative means to the custodial sentence in the city of Guayaquil, in the reduction of prison overcrowding, an investigation was carried out that proposes to highlight the role that this represents. mechanism in the mitigation of the problems of the country's prison system and in the elimination of the cycle of violence and criminality. Among the results of this investigation, the importance of the inclusion of the conditional suspension of the second instance procedure was identified in the reduction of overcrowding, protection of the constitutional rights of persons deprived of liberty and the integral reparation of the victims.
