Igualdad de oportunidades para las partes sobre la tenencia y custodia de los niños, niñas y adolescentes

Abstract

La igualdad de oportunidades, es un principio, que promueve la Constitución de la República del Ecuador, prevaleciendo corresponsabilidad parental y un vínculo parento filial afectivo de padres hacia hijos, debiendo aplicarse al momento de otorgar la tenencia y custodia de niños, niñas y adolescentes; el presente trabajo investigativo de carácter jurídico, analizó incumplimiento del principio de igualdad de oportunidades, para las partes sobre la tenencia, custodia de menores de edad, en el artículo 106, numeral 4, expone, que si los progenitores muestran igualdad de condiciones se preferirá a la madre, para que bajo su tutela quede el cuidado, protección del menor de edad. Las metodologías empleadas son: científica (responde a causas de la problemática planteada); analítica (análisis de textos doctrinarios, jurídicos, legales, sentencias), permitiendo diagnosticar el objetivo principal de la investigación; cualitativa comprobando, que habrá igualdad de oportunidades, al otorgarse una tenencia compartida, donde las partes muestren igualdad de condiciones.
