Facultad de los Jueces en Fase de Ejecución en el Ecuador. Análisis del Art. 364 del COGEP

Abstract

El presente estudio de caso se manifiesta de manera relevante en las necesidades que existen para los demandados en los procesos de ejecución, en caso de que el ejecutado alegue pagos parciales realizados antes de que le presenten dicha demanda y al ser citados con el mandamiento de ejecución y no antes que se dicte el mismo, para garantizar así el estricto cumplimiento del principio de igualdad, de contradicción y para precautelar la tutela judicial y la seguridad jurídica en dichos procesos. El análisis de la normativa legal de la Constitución de la República del Ecuador y del Código Orgánico General de Procesos, nos permite conocer las garantías que, El Estado y la Función Judicial por medio de sus Jueces, promuevan una justicia eficaz, oportuna e imparcial, que aseguren el ejercicio y goce pleno de sus derechos.

The present case study is manifested in a relevant way in the needs that exist for the defendants in the execution processes, in case the defendant alleges partial payments made before said demand is presented and when they are summoned with the execution order. and not before it is issued, in order to guarantee strict compliance with the principle of equality, of contradiction and to protect judicial protection and legal certainty in said processes. The analysis of the legal regulations of the Constitution of the Republic of Ecuador and the General Organic Code of Processes, allows us to know the guarantees that the State and the Judicial Function through its Judges, promote an effective, timely and impartial justice, that ensure the exercise and full enjoyment of their rights.
