Análisis de la Acción Extraordinaria de Protección presentada por la ciudadana Miriam Salazar Jiménez

Abstract

La presente propuesta tiene como propósito aportar al conocimiento de la garantía de derechos, puesta a disposición de los ecuatorianos por la Constitución de la República, como mecanismo de jurisdicción constitucional para la protección de sus derechos cuando fueren vulnerados, por acción u omisión de los jueces, en las decisiones que les corresponde adoptar en las causas puestas a su conocimiento. Hacia este objetivo, esta propuesta investigativa se basará en el fundamento jurídico y teórico de este mecanismo de protección en el marco de la orientación garantista constitucional. La propuesta de investigación desarrollará un estudio detallado de esta garantía de derechos, de la misma manera se ofrecerá una visión global de aspectos, tales como: la naturaleza jurídica de la acción, sus objetivos, funciones, requisitos de proceso, actos impugnables, derechos protegidos, el procedimiento, la sentencia y sus efectos, bajo cuyos contenidos se realizará el análisis de la acción extraordinaria de protección presentada por la ciudadana Miriam Salazar Jiménez N.º 120 -18 –SEP-CC; caso N.º 1225-15-EP

The purpose of this proposal is to contribute to the knowledge of the guarantee of rights, made available to Ecuadorians by the Constitution of the Republic, as a mechanism of constitutional jurisdiction for the protection of their rights when they are violated, by action or omission of the judges , in the decisions that correspond to them to adopt in the causes put to their knowledge. Towards this objective, this research proposal will be based on the legal and theoretical basis of this protection mechanism within the framework of the constitutional guarantee orientation. The research proposal will develop a detailed study of this rights guarantee, in the same way a global vision of aspects will be offered, such as: the legal nature of the action, its objectives, functions, process requirements, objectionable acts, protected rights , the procedure, the sentence and its effects, under whose contents the analysis of the extraordinary protection action presented by the citizen Miriam Salazar Jiménez No. 120 -18 –SEP-CC; case No. 1225-15-EP.
