Discriminación salarial en contra de los operarios artesanales y el principio constitucional de igualdad de remuneración

Abstract

El propósito de esta investigación es demostrar que el artículo 115 del Código del Trabajo es una norma discriminatoria, ya que excluye de forma expresa a los operarios artesanales, del derecho a recibir la decimotercera y decimocuarta remuneraciones, que fueron creadas con la finalidad de ayudar a los trabajadores a solventar los gastos de los preparativos navideños y de ayudarlos a pagar los estudios de sus hijos. Por esta razón, se analizará el principio de igualdad e igualdad de remuneración, a fin de conocer su alcance y determinar cuándo estamos frente a un acto discriminatorio; se analizará el régimen artesanal, las razones por las que se creó un régimen especial para los artesanos, y los beneficios que se otorgan para ellos; y, finalmente, se estudiará la situación de los operarios artesanales para conocer sus necesidades, sus puntos de vista respecto a este tema y cómo les afecta.

The purpose of this investigation is to demonstrate that article 115 of the Labor Code is a discriminatory norm, since it expressly excludes artisanal workers from the right to receive the thirteenth and fourteenth remunerations, which were created with the purpose of helping the workers to cover the expenses of the Christmas preparations and to help them pay for the studies of their children. For this reason, the principle of equality and equality of remuneration will be analyzed, in order to know its scope and determine when we are facing a discriminatory act; the artisanal regime will be analyzed, the reasons why a special regime for artisans was created, and the benefits that are granted for them; and, finally, the situation of artisanal workers will be studied to know their needs, their points of view regarding this issue and how it affects them.
