Inadmisión e improcedencia de la acción de habeas data propuesto por José Aguirre contra el GAD Simón Bolívar.

Abstract

El Ing. José Aguirre Villavicencio, en su calidad de legitimado activo interpone Acción de Habeas Data en contra del Alcalde y Procuradora Sindica del Gobierno Descentralizado de Simón Bolívar, con la pretensión de la activación de esta Garantía Constitucional, el Juez ordene a los personeros del GAD se confieran las copias certificadas que reposa en los archivos respecto de información del accionante y se declare vulneración de su derecho en el Art. 92 de la Constitución, previamente el accionante ha cursado tres solicitudes en fechas distintas en el lapso de un año sin recibir respuesta alguna, denegación tacita que le impide el acceso a la información requerida; la Jueza resuelve de manera oral Inadmite la Acción de Habeas Data, por considerar que, la finalidad del habeas data no se persigue la entrega de documentos pertenecientes a entidades públicas o privadas; más en la sentencia escrita, declara "Improcedente la acción".

Engineer José Aguirre Villavicencio, in his capacity as a legitimate asset, filed Habeas Data Action against the Mayor and Syndical Procurator of the Decentralized Government of Simón Bolívar, with the pretense of the activation of this Constitutional Guarantee, the Judge ordered the representatives of the GAD confer certified copies that rests in the files regarding information of the plaintiff and is declared a violation of its right in Art. 92 of the Constitution, previously the plaintiff has filed three applications on different dates in the span of a year without receiving any response, tacit denial that prevents access to the required information; the Judge resolves orally Inadmits the Habeas Data Action, considering that the purpose of habeas data is not to deliver documents belonging to public or private entities; more in the written statement, declares "Unjustified action."
