| dc.description | El presente trabajo tiene como fin resolver y encontrar un mecanismo de mayor eficacia que resuelva las disputas surgidas en el contrato de construcción bajo la Ley de Contrataciones del Estado. El autor nos presenta a la Junta de Resolución de Disputas como un mecanismo que permite la solución de controversias durante la ejecución de la obra, siendo ello comparado con el arbitraje, teniendo ambos mecanismos una filosofía distinta. Asimismo, se enfatiza que, si se desea tener una gestión correcta del proyecto constructivo, se tiene que priorizar en la prevención del conflicto, sin dejar de lado la eficacia del arbitraje para temas puntuales. | |
| dc.description | This paper tries to solve and find a mechanism of greater efficiency to resolve the arising disputes in the construction contract under the Peruvian State Procurement Law. The author introduces us to the Dispute Board as a mechanism that allows the resolution of disputes during the execution of the work, being compared to the arbitration, both mechanisms having different philosophies. Likewise, it´s emphasized that if you want to have a correct management of the construction project, you have to prioritize the prevention of conflict, without neglecting the effectiveness of arbitration for specific issues. | |
