| dc.description | El presente artículo tiene como propósito exponer el marco legal vigente aplicable a los procesos de adquisición y expropiaciónde inmuebles a cargo de las entidades del Estado, el cual debe ser ejecutado de manera eficiente, buscando armonizar las necesidades públicas con los derechos de los propietarios y poseedores de inmuebles afectados por la ejecución de obras públicas. Asimismo, se expone ciertos aspectos cuestionables del actual régimen jurídico, toda vez que llevado a la práctica no ofrece soluciones claras y efectivas para la protección del derecho de propiedad. | |
| dc.description | This article has the purpose of explain the applicable legal framework in force for the procedures of expropriation and acquisition of properties in charge to State agencies, which should be executed efficiently, seeking to harmonize the State interest’s with the rights of the owners and possessors of the property, called passive subject. Likewise, this article exposes questionable aspects of the current legal regime, considering that in the practice it does not provide clear and effective protection of the property right. | |
