dc.descriptionIn our legal system, when an economic agent is in a stage of non-compliance, it has the possibility to choose the insolvency process to reverse the result of this situation. One of the effects of this process is the protection of the assets of the debtor through different mechanisms among which are the institution of ineffective acts. However, the institution mentioned in our country has unclear regulations. That is why its main role, the protection of insolvency, is dissatisfied.Since the entry into force of the General Law of the Insolvency System in October 2002, this institution has not undergone changes that are in line with the economic development of the country. In this sense, it is important to analyze the different insolvency laws in America and Europe in relation to the institution of ineffective acts. The crises that have faced their economies in recent years have led States to continue to modify their regulation on the institution of ineffective acts. It is worth highlighting and analyzing the positive aspects of this regulation to improve our legislation, with the respective restrictions given the particularities of the economy of each country.en-US
dc.descriptionEn nuestro ordenamiento jurídico, cuando un agente económico se encuentra en una etapa de cesación de pagos, para revertir o salir de esta situación puede optar por acceder al sistema concursal, el cual tiene como uno de sus efectos la protección del patrimonio del deudor concursado mediante diferentes mecanismos entre los que se encuentran la institución de la ineficacia concursal.Sin embargo, la mencionada institución en nuestro país tiene una regulación poco clara, lo que ha hecho que su rol principal, la protección del patrimonio del insolvente, no sea cumplida. Más aun si desde la entrada en vigencia de la Ley General del Sistema Concursal en octubre de 2002 esta institución no ha sufrido modificación alguna que sea acorde al desarrollo económico del país.En ese sentido, es importante analizar las diversas legislaciones concursales en América y Europa en torno a la ineficacia concursal; toda vez que las crisis que han afrontado sus económicas en los últimos años han ocasionado que los Estados mantengan o modifiquen su regulación sobre la referida institución. Vale resaltar y darle una mirada a lo positivo de estas y a aquello que se puede rescatar para que de alguna manera fortalezca nuestra legislación, con las respectivas restricciones dada las particularidades en la economía en cada país.es-ES
