dc.description The patrimonial responsibility of the State is an issue belonging to the general part of administrative law. In Peruvian law, this institution does not have a clear and deep theoretical development as the civil liability system applied in private law does. Through this paper, the author outlines some generic considerations on the foundations of the duty to compensate by the Public Administration, generated when, in the exercise of its legally attributed powers, it causes injuries to the legally protected interests of the administered. Thus, the purpose of this work is to establish an approximation at the national headquarters on the theory of the patrimonial responsibility of the State, without prejudice to recognizing the influence of some institutions of private law.en-US
dc.description La responsabilidad patrimonial del Estado es un tema perteneciente a la parte general del derecho administrativo. En el derecho peruano, esta institución no tiene un claro y profundo desarrollo teórico como sí lo tiene el sistema de responsabilidad civil aplicado en el derecho privado. Mediante el presente trabajo, el autor esboza algunas consideraciones genéricas sobre los fundamentos del deber de resarcir a cargo de la Administración Pública, generada cuando, en el ejercicio de sus potestades atribuidas legalmente, causa lesiones en los intereses jurídicamente tutelados de los administrados. Así, el propósito de este trabajo es establecer una aproximación en sede nacional sobre la teoría de la responsabilidad patrimonial del Estado, sin perjuicio de reconocer la influencia de algunas instituciones del derecho privado.es-ES
