Should Kelsen’s positivism prevail in commercial law? Should sectorial rules of risk allocation be included in a Civil Code?.The present article answers with effectiveness each one of these questions with the purpose of demonstrating that in commercial law the source par excellence should be the Lex Mercatoria.en-US
dc.description¿Cómo se crean las normas comerciales? ¿Deben ser creadas de forma constructivista o se crean más bien mediante un orden espontáneo? ¿Tiene sentido que el positivismo kelseniano prevalezca en el derecho comercial? ¿Tiene sentido que se recojan en un Código Civil normas sectoriales de asignación de riesgos?.El presente artículo responde con contundencia cada una de estas interrogantes con el propósito de demostrar que en el derecho comercial la fuente por excelencia debería ser la Lex Mercatoria.es-ES
