dc.descriptionCollaterals are actives (material and immaterial) that act as warrants against any financial operation. This figure allows to reduce risks related to financial operations throughout credit qualification of the protected agent. For this reason, an adequate regulation of its execution (ex ante and ex post) is useful to reduce situations originated by information asymmetry.In this article, the autor develops the legal treatment of this juridical figure and its applicable regimens, analyzing the juridical and economic implications of the two ways to protect its execution: juridical proceedings (ex ante) and extra juridical proceedings (ex post).en-US

Esta figura permite reducir los riesgos relacionados a las operaciones financieras por medio de la calificación crediticia del agente al que se respalda. Es por ello que una adecuada regulación de su ejecución permite reducir los problemas originados por la asimetría de información.En el presente artículo, el autor desarrolla el tratamiento legal de esta figura jurídica y los regímenes aplicables a la misma, analizando las implicancias jurídicas y económicas de los dos medios de protección para su ejecución: la vía judicial (ex ante) y la vía extra judicial (ex post).es-ES
