dc.description | This paper examines the political and criminal implications of Jakobs' recent conception of the Peruvian judicial system within a state where the Constitution is the supreme rule. The analysis highlights the shortcomings of Jakobs' thesis of positive general prevention in relation to the function of criminal law in our legal system. The article argues that Jakobs' approach disregards important constitutional principles and fails to consider fundamental rights that protect individuals from excessive use of punitive power by the State. This can lead to a dangerous weakening of the role of the courts. Consequently, this would undermine the functions of judicial operators and increase the power of the criminal legislator, which is not in line with the principles of a democratic state. | en-US |
dc.description | El presente trabajo expone las consecuencias político-criminales que tiene la más reciente concepción de Jakobs sobre el sistema judicial peruano en el marco de un Estado donde la Constitución prevalece como norma suprema. El análisis se centra principalmente en señalar que la tesis de la prevención general positiva, propuesta por Jakobs, posee severas falencias respecto a la función que tiene el derecho penal en un sistema jurídico como el nuestro. En esa medida, el artículo revela que el planteamiento de Jakobs desconoce principios constitucionales relevantes, y en la medida en que dicha teoría no tome en cuenta la existencia de derechos fundamentales que protegen a las personas de un uso desmedido del poder punitivo por parte del Estado, se advierte un peligroso debilitamiento en el rol de los tribunales. En consecuencia, se estaría hablando de un menoscabo en las funciones de los operadores judiciales y un incremento de poder en el legislador penal, lo cual no se alinea con la realidad de un Estado democrático. | es-ES |
