This paper highlights the need to examine the role of a constituent assembly within a democratic and constitutional system. To this end, a detailed analysis of the issue is undertaken on the basis of doctrine and constitutional history. It is concluded that the purpose of a constituent assembly is to establish a constituent power and to reform the constitution. Constituent power is the ability of a society to create or reform fundamental rights and the structure of government. Thus, the Constituent Assembly is the way in which the people exercise this power with the aim of amending the existing constitution or creating a new one. However, the author points out that there is one element that cannot be excluded by this power, and that is constitutional democracy. In this sense, this article provides a detailed study that helps to understand what a Constituent Assembly implies as a key entity for the strengthening and development of democracy, highlighting its importance for the stability and legitimacy of a country's legal system.El presente trabajo resalta la necesidad de examinar el rol que asume una Asamblea Constituyente en el marco de un sistema democrático y constitucional. Con este propósito, se aborda un análisis detallado sobre el tema a partir de la doctrina y la historia constitucional. A partir de ello, se determina que la finalidad de la Asamblea Constituyente radica en la instauración de un poder constituyente y en la reforma constitucional. El poder constituyente viene a ser la capacidad que tiene una sociedad de crear o reformar los derechos fundamentales y la estructura del gobierno. Es así que la Asamblea Constituyente es la forma en la que las personas ejercen este poder, con el objetivo de modificar la Constitución vigente o crear una nueva. Sin embargo, el autor remarca que existe un elemento que no podrá ser excluido por este poder y dicho componente es la democracia constitucional. En esa medida, este artículo proporciona un estudio detallado que ayuda a comprender lo que implica una Asamblea Constituyente como un ente clave para el fortalecimiento y desarrollo de la democracia, resaltando su importancia en la estabilidad y legitimidad del sistema jurídico de un país.
