| dc.description | The author focuses on social responsibility from the legal angle given that imputations can be given for the breach of obligations. In this way, the article begins by showing the background of the SR in which he underwent a paradigm shift from the altruistic or philanthropic concept to the socio-environmental concept. The aforementioned change shows that the RS does not only correspond to the interests of the company-shareholders-but also involves all the members of the company- stakeholders. Second, the author explores the different definitions of the concept of social responsibility, including the approaches of the Green Paper, the Red Forum and other contributions of the international community. Now it is important to highlight the interrelation between socio-environmental responsibility and Law. As a result, national legislation and case law are mentioned as they contribute to an adequate constitutional framework. Based on this, the author emphasizes that the stability of the company is generated not only from the State but also from the participation of the same companies that should be the protagonists. Added to this, is the infra-constitutional regulation in which the General Environmental Act stands out. Finally, the author comments on three mechanisms to motivate the business sector: standards with technology performance standards, economic self-regulation, economic instruments in government intervention. In conclusion, the author proposes that both legal norms and voluntary standards have a legal approach that contributes to the application of standards. | en-US |
| dc.description | El autor enfoca la responsabilidad social desde el ángulo jurídico dado que se pueden dar imputaciones por el incumplimiento de las obligaciones. De esta manera, se inicia el artículo mostrando los antecedentes de la RS en la que sufrió un cambio de paradigma del concepto altruista o filantrópico al concepto socioambiental. El mencionado cambio muestra que la RS no solo corresponde a los intereses de la empresa- shareholders- sino también se involucra a todos los miembros de la empresa- stakeholders. Segundo, el autor explora las distintas definiciones del concepto de responsabilidad social incluyendo los enfoques del Libro Verde, Red Forum y otros aportes de la comunidad internacional. Ahora bien, es importante resaltar la interrelación entre la responsabilidad socio-ambiental y el Derecho. En consecuencia, se hará mención a la legislación y jurisprudencia nacional en la medida de que contribuyan a un adecuado maro constitucional sobre el tema en mención. En función a ello, el autor hace énfasis en resaltar que la estabilidad de la empresa no solo se genere desde el Estado sino también desde la participación de las mismas empresas que deben ser los protagonistas. Sumado a ello, esta la normativa infraconstitucional en la que se destaca la Ley General del Ambiente. Por último, el autor comenta tres mecanismos para motivar al sector empresarial: normas con estándares de rendimiento de tecnología, autorregulación económica, instrumentos económicos en la intervención gubernamental. En conclusión, el autor propone que tanto las normas jurídicas y como las normas voluntarias deben ser observadas desde pautas jurídicas con el objetivo de ir más allá de la normatividad aplicable. | es-ES |
