Análise da legalidade do exercício do cargo comissionado na presidência do Fundo Social de São Paulo

Abstract

O presente estudo analisou a legalidade da ocupação do cargo comissionado de presidente do Fundo Social de São Paulo pela primeira dama do estado, por nomeação do governador em exercício. Para tanto foi estudada a estrutura deste órgão, assim como os princípios constitucionais da Administração Pública. Em seguida foi conduzido estudo sobre as hipóteses de improbidade administrativa, seu procedimento legal e penalidades. Por fim foi analisada a Súmula Vinculante nº13, do Supremo Tribunal Federal, que trata sobre nepotismo, assim com a jurisprudência que lhe deu origem e a que lhe sucedeu, explicando-a. Ao final, comparando tais informações levantadas, pode-se perceber que o exercício do cargo comissionado de presidente do Fundo Social de São Paulo pela primeira dama do estado é legal e legítimo.

The present study analyzed the legality of the occupation of the commissioned position of president of the Social Fund of São Paulo by the first lady of the state, by appointment of the acting governor. Therefore, the structure of this body was studied, as well as the constitutional principles of Public Administration. Then, a study was conducted on the hypotheses of administrative improbity, its legal procedure and penalties. Finally, Binding Precedent nº 13, of the Federal Supreme Court, which deals with nepotism, was analyzed, as well as the jurisprudence that gave rise to it and the one that followed it, explaining it. In the end, comparing such information collected, it can be seen that the exercise of the commissioned position of president of the Social Fund of São Paulo by the first lady of the state is legal and legitimate.
