Homoparentalidade nas relações homoafetivas: adoção e reprodução assistida

Abstract

O reconhecimento formal das uniões homoafetivas como entidades familiares, a partir do julgamento conjunto da Ação Direta de Inconstitucionalidade (ADI) nº 4277, e da Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 132, em 2011, motivou o fortalecimento de outra reinvindicação desses casais: o desejo de vivenciar a maternidade/paternidade, no seio da família, com a deflagração de todos os direitos e deveres inerentes ao parentesco. Esse novo paradigma parental se deu diante da repersonalização das relações familiares, a partir da promulgação da Constituição Federal de 1988, trazendo a dignidade da pessoa humana para o núcleo do ordenamento jurídico. Assim, expõe-se, nesta pesquisa, dentre as formas de concretização da homoparentalidade, a adoção e a reprodução humana assistida, abrangendo os dois indivíduos no casal no que tange ao reconhecimento da paternidade/maternidade em relação à criança. Tratando da adoção, percebe-se que não existem óbices para sua concessão ao indivíduo homoafetivo, ao passo que a adoção, quando promovida por casal homoafetivo, permanece encontrando diversos obstáculos jurídicos baseados no preconceito. No mais, a utilização de técnicas de reprodução assistida por pares homoafetivos vem crescendo a cada dia, a ensejar o reconhecimento jurídico da parentalidade a ser exercido por ambos os componentes do casal, e não somente aquele que gestou o embrião. A filiação passa a ser identificada, sobretudo, pela presença do vínculo afetivo, sendo que se deve considerar a autonomia da vontade e a responsabilidade parental como elementos indispensáveis ao estabelecimento de vínculos jurídico-parentais. O problema norteador da presente pesquisa decorre das lacunas no ordenamento jurídico que dificultam o exercício do direito à homoparentalidade dos casais homoafetivos por meio da adoção ou da reprodução humana assistida. O objetivo geral da pesquisa é examinar em que medida se dá a efetivação do princípio da afetividade, da dignidade da pessoa humana e do direito à parentalidade, a partir do direito de constituição da paternidade/maternidade no seio da família homoafetiva, representadas no reconhecimento da adoção ou através do uso da reprodução assistida por casais homoafetivos. No estudo e desenvolvimento da pesquisa utiliza-se, como método de pesquisa, a abordagem dedutiva, estruturada sob o enfoque da dialética jurídica. A pesquisa jurisprudencial, realizada junto aos sites do Superior Tribunal de Justiça e Supremo Tribunal Federal, revela que casais homoafetivos vêm, progressivamente, recebendo a tutela que lhes resguarda todos os direitos e deveres inerentes ao poder familiar, ao passo que se reconhece a bipaternidade ou a bimaternidade.

The formal recognition of same sex unions as family entities, based on the joint judgment of the Direct Unconstitutionality Action (ADI) nº 4277, and and the request for non-compliance of basic principles (ADPF) nº 132, in 2011, motivated the strengthening of another claim of these couples: the desire to experience motherhood/fatherhood, in the family, with the outbreak of all the rights and duties inherent to kinship. This new parenting paradigm took place due to family relationships changes, since the promulgation of the Federal Constitution of 1988, putting the dignity of the human person to core of the legal system. Thus, this research aims to study homoparenthood, specifically the adoption and assisted reproductive technology, encompassing the couple regarding to the recognition of fatherhood/motherhood in relation to the child. Dealing with adoption, it is clear that there are no obstacles to granting it to the homosexual, whereas the adoption promoted by a same sex couple continues to encounter several legal obstacles based on prejudice. In addition, the use of assisted reproductive technology by same-sex couples has been growing every day, giving rise to the legal recognition of parenthood to be exercised by both components of the couple, and not only by the one who received the embryo. The affiliation is now identified mainly by the presence of the affective bond, considering the autonomy of the will and parental responsibility as essential elements for the establishment of legal parental bonds. The guiding problem of this research runs from the gaps in the legal system that hinder the exercise of the right to homoparenthood by same-sex couples through adoption or assisted reproductive technology. The general objective is to examine how the principles of affectivity, the dignity of the human person and the parenting right takes effect, based on the right to establish fatherhood/motherhood within the same-sex families, represented in the recognition of adoption or by the use of assisted reproductive technology by them. In this research, the deductive approach is used as a research method, structured under the focus of legal dialectics. The precedents research was carried out on the websites of the Superior Court of Justice and the Supreme Federal Court and reveals that same-sex couples have been progressively receiving legal protection that saves them all the rights and duties inherent to family power, while recognizing bipaternity or bimaternity.
