Direito humano de acesso à água pelos palestinos: o problema hídrico no conflito árabe-israelense

Abstract

O conflito árabe-israelense no Oriente Médio iniciou quando a Organização das Nações Unidas (ONU) declarou a intenção de criar um Lar Judeu na Palestina. A partir desse evento, surgiram várias reivindicações de direitos tanto do lado judaico quanto árabe, as quais resultaram em sucessivas guerras até os dias atuais. Este trabalho analisa o conflito sob o enfoque hídrico - uma questão que exerce muita influência na vida cotidiana desses dois povos, em especial nos processos de paz, por meio das legislações internacionais a respeito do direito humano de acesso à água, confrontando-as com as leis israelenses com o objetivo de verificar se estas estão de acordo com os tratados internacionais e se tutelam os direitos dos árabes de usufruírem água em quantidade e qualidade adequadas a sua sobrevivência.

Abstract : The Arab-Israeli conflict is a dispute taking place in the Middle East. It started when the United Nations declared its intention to create a Jewish Home in Palestine. From this event began to arise several claims of rights both from the Jewish side, as well as from the Arabic, resulting in successive wars. Various reasons are pointed out as the cause of wars between Arabs and Jews, be they religious, cultural or territorial reasons. This work analyzes the hydric approach, as it is one of the factors that exerts much influence in the dispute between these two peoples, as well as in all peace processes between Jews and Palestinians. This dissertation analyses the international legislation on the human right of access to water and verifies whether Israeli laws are in accordance with international treaties and whether they protect the Arabs' right to enjoy water in adequate quantities and of adequate quality.
