The existence of public administration is a feature common to all nations, whatever the system of government. While the day-to-day responsibilities of public administrators can vary greatly depending on the type of organization they work for, the common thread among public administrators is typically a deep commitment to serving their communities and contributing to their overall betterment. And to serve the common good, the public administration needs certain functions to be performed directly by its servants, or, through third parties who are hired to carry out activities that contribute to the public administration fulfilling its institutional role. Public-private partnerships involve collaboration between a government agency and a private sector company that can be used to finance, build and operate projects. A performance contract is an agreement between a government and a public agency or private company that sets general targets for another agency or supplier, sets targets for measuring performance, and provides incentives to achieve those targets. They include a variety of incentivebased mechanisms to control public agencies or providers and control the outcome rather than the process. This research has the general objective of analyzing the use of performance contracts for Public-Private Partnerships in the sanitation area. The methodology adopted in the formulation of the work was a case study in an area of great population density in the state of São Paulo, based on bibliographic research and documental research. Among the findings of this research, it was observed that the goal of implementing the minimum scope of the contract and the reduction of the Lost Volume was reached, surpassing in 04 months of the implementation period, with results above 120% of the goal.
