dc.description.abstractNowadays, knowledge and technology acquired a key role in trade relations, surpassing, by far, the value of mineral reserves, as well as the commodities produced. Thus, the technology creation through the research and development processes (R & D) is the basis for a country to stop being only a supplier of raw materials and commodities to effectively become a developed country. This way, the role of technological innovation is presented as crucial in the economic and social development process. The reason for innovation is based essentially on two aspects: the first one is the conquest of new markets and the second reducing costs. However, developing technologies is not enough, it is necessary to protect this technology so the author can enjoy the profits and benefits. The technology protection is done through patents, which give the author the exclusive privilege of its use, being able to produce it personaly, license it, and also exclude others from the relationship with the object of the patent. In Brazil, the major developers of technology are in the tertiary education institutions, however, the developed technology is not always protected by patents. Thus, it is a literature review on the subject intellectual property, industrial property, focusing on the patent issue in the aspects of technological innovation and Innovation Act. This work, based on the Post-Graduation Program in Electric Engineering and Industrial Computing (CPGEI) of the Federal Technological University of Paraná (UTFPR), seeks to try to establish whether the factors of the probable low number of patents generated in relation to the number of published scientific papers, as well as if the Law of Innovation helped solve the problem and how.
