Política nacional de resíduos sólidos: estudo de caso no município de Blumenau/SC

Abstract

This study aimed to study the implementation of the National Solid Waste Policy, pursuant to Law 12,305 / 2010, covering the historical part of the environmental law in Brazil and culminating in verifying the implementation of the policy in the city of Blumenau. The analysis was also made by the constitutional bias, since it is the basis of the national legal system. In the same vein, the study discusses issues concerning the Law 9.605 of February 12, 1998, justifying, as this provides for the criminalization of irregular disposal of waste, including solid. Likewise, it is of paramount importance to the appreciation of the law connected to the National Solid Waste Policy. Thus, at an appropriate time, too, we evaluated the Law 11.445 / 2007, Law 9,974 / 2000 and Law 9,966 / 2000. Finally, it pointed out that the proposed theme was not limited to literature and theoretical study of the National Solid Waste Policy, since the study made available to notes obtained in situ research, raised by the visit to Blumenau city's Recycling Cooperative .
