Protección de los derechos humanos de los migrantes mediante el Estatuto temporal de protección para los migrantes venezolanos

Abstract

El presente trabajo tuvo como finalidad principal analizar cómo el estatuto temporal de protección para migrantes venezolanos contribuye a la protección de los derechos humanos de estas personas que por circunstancias ajenas a su voluntad se han visto en la obligación su país de origen. Esta problemática, ha sido objeto de estudio de diferentes académicos a nivel mundial, lo que permite una mayor consolidación y seriedad a la investigación, gracias a las diferentes teorías recopiladas. Respecto de la metodología, se usó una investigación de tipo cualitativa, con enfoque hermenéutico, en la cual se realizó una revisión exhaustiva de documentos, sentencias, normatividad, y doctrina que sirvieron de base para obtener la información necesaria para sacar adelante el presente estudio. Dentro de los resultados obtenidos, se logró llegar a establecer que el Estatuto Temporal para los migrantes venezolanos, ha sido de gran alivio para estos, ya que brinda seguridad jurídica tantos para ellos, como para los ciudadanos colombianos al tener un registro de quienes se encuentran en territorio colombiano, para de esta manera tener un mayor control judicial de ser necesario. Finalmente, el impacto del estatuto es positivo y de un alcance importante, lo que en últimas es uno de los grandes objetivos de la política migratoria internacional, siguiendo las disposiciones emitidas por los diferentes órganos institucionales. A modo de conclusión, sin tener la última palabra, el Estado Colombiano, está siendo garante de los derechos de estas personas, al disponer recursos humanos, y financieros para cubrir las necesidades de estas personas

The main purpose of this work was to analyze how the temporary status of protection for Venezuelan migrants contributes to the protection of the human rights of these people who, due to circumstances beyond their control, have been forced into their country of origin. This problem has been the object of study by different academics worldwide, which allows greater consolidation and seriousness of the investigation, thanks to the different theories compiled. Regarding the methodology, a qualitative research was used, with a hermeneutical approach, in which an exhaustive review of documents, sentences, regulations, and doctrine was carried out that served as the basis for obtaining the necessary information to carry out the present study. Among the results obtained, it was possible to establish that the Temporary Statute for Venezuelan migrants has been of great relief to them, since it provides legal security for both them and Colombian citizens by having a record of those who are in Colombian territory, in order to have greater judicial control if necessary. Finally, the impact of the statute is positive and of a significant scope, which is ultimately one of the great objectives of international migration policy, following the provisions issued by the different institutional bodies. In conclusion, without having the last word, the Colombian State is being a guarantor of the rights of these people, by providing human and financial resources to meet the needs of these people
