| dc.description | Education is framed in a teaching and learning process imparted and disseminated by educators, developing what is known under the law and educational dogmatics as the teaching function; it is exercised in the public institutions of the Venezuelan state and in private institutions. Likewise, teachers, especially those of the State, in their different territorial levels, are under the disciplinary regime, called in the legal doctrine as an administrative sanction under the figures of reprimand and / or removal from office. The objective of the work was to analyze the theoretical legal postulates of the official sanctioning regime for teachers established in Venezuelan law and the relevance of its application by superiors. It was based on the analysis of the constitution, laws, regulations and doctrinal contributions of Durán (2014); Rojas (2011), Becerra (2009); Brewer (1980), among others. The methodology used was descriptive documentary. After the analysis carried out, it is highlighted that the disciplinary process is carried out in two phases; which, in those cases, in which a professor has allegedly incurred in facts that could be qualified and warrant removal from office, or, dismissal and disqualification; The respective initial administrative inquiry will be ordered to be carried out, which will determine the teaching responsibility established in the various postulates of law. | en-US |
| dc.description | La educación se encuentra enmarcada en un proceso de enseñanza y aprendizaje impartido y difundido por los educadores, al desarrollar lo que se conoce bajo la ley y la dogmática educativa como la función docente; la misma es ejercida en las instituciones públicas del estado venezolano y en instituciones privadas. Así mismo los profesores, en especial referencia a los del Estado, en sus diferentes niveles territoriales, se encuentran bajo el régimen disciplinario, llamado en la doctrina jurídica como sanción administrativa bajo las figuras de amonestación y/o destitución del cargo. El objetivo del trabajo fue analizar los postulados teóricos legales del régimen sancionatorio funcionarial del docente establecido en la legislación venezolana y la pertinencia de su aplicación por parte de los superiores. Se fundamentó en el análisis de la constitución, leyes, reglamentos y aportes doctrinarios de Durán (2014); Rojas (2011), Becerra (2009); Brewer (1980), entre otros. La metodología empleada fue documental de tipo descriptivo. Luego del análisis realizado se resalta que el proceso disciplinario se lleva a cabo en dos fases; las cuales, en aquellos casos, en que un profesor presuntamente hubiere incurrido en hechos que pudiera ser calificados y ameriten la separación del cargo, o, destitución e inhabilitación; se ordenará llevar a cabo la respectiva averiguación administrativa inicial, la cual determinará la responsabilidad docente establecida en los diversos postulados de ley. | es-ES |
