dc.descriptionHuman rights constitute powers or prerogatives that every person has before the organs of public power to preserve their dignity as a human being, and whose function is to exclude the interference of the State in their subjective sphere. The objective of this work is to analyze the concept, legal nature and methods of interpretation of the 1969 American Convention on Human Rights, in order to verify the complaint of the violation of the pro homini principle and the principle of progressiveness by the Venezuelan State. A documentary research methodology based on the analytical and historical method was used. The 1969 American Convention on Human Rights sets up a universal multilateral international human rights treaty, designed so that the States parties undertake to respect the rights and freedoms recognized in it and to guarantee their free and full excercise to all persons subject to their jurisdiction, without any discrimination on the bases of race, color, sex, language, religion, political opinions or of any other nature. This convention is considered the normative basis of the Inter-American System for Promotion and Protection of Human Rights. The Venezuelan State denounces the convention on September 6, 2012 and the General Secretariat of the Organization of American States receives it on September 10, 2012. It is concluded that the application of the clause of denunciation provided for in Article 78 of the American Convention on Human Rights of 1969 by Venezuelan government, as a State party as of September 2012, is a pro-government application that disapplies the methods of interpretation of the American Convention on Human Rights of 1969, referring to the interpretation of good faith, efficient interpretation, pro persona or pro homini interpretation and progressive or evolutionary interpretation.en-US
dc.descriptionLos derechos humanos constituyen facultades o prerrogativas que detenta toda persona frente a los órganos del poder público para preservar su dignidad como ser humano, y cuya función es excluir la interferencia del Estado en su esfera subjetiva. El objetivo de este trabajo consiste en analizar el concepto, naturaleza jurídica y métodos de interpretación de la Convención Americana sobre Derechos Humanos de 1969, a fin de comprobar la denuncia a la violación del principio pro homini y el principio de progresividad por parte del Estado venezolano. Se utilizó una metodología de investigación documental sustentada en el método analítico e histórico. La Convención Americana sobre Derechos Humanos de 1969 configura un tratado internacional universal multilateral de derechos humanos, diseñado para que los Estados parte se comprometan a respetar los derechos y libertades reconocidos en ella y a garantizar su libre y pleno ejercicio a toda persona sujeta a su jurisdicción, sin discriminación alguna por motivos de raza, color, sexo, idioma, religión, opiniones políticas o de cualquier otra índole. Esta convención es considerada la base normativa del Sistema Interamericano de Promoción y Protección de los Derechos Humanos. El Estado venezolano denuncia la convención en fecha 6 de septiembre de 2012 y la Secretaría General de la Organización de Estados Americanos la recibe en fecha 10 de septiembre de 2012. Se concluye que la aplicación de la cláusula de denuncia prevista en el artículo 78 de la Convención Americana sobre Derechos Humanos de 1969 por parte del gobierno venezolano, como Estado parte para la fecha septiembre de 2012, resulta una aplicación pro-gobierno que desaplica los métodos de interpretación de la Convención Americana sobre Derechos Humanos de 1969, referidos a la interpretación de buena fe, interpretación eficiente, interpretación pro persona o pro homini y la interpretación progresiva o evolutiva.es-ES
