A Reforma Trabalhista pela ótica dos desembargadores do TRT 1

Abstract

A Reforma Trabalhista, como popularmente é conhecida a Lei nº 13.467, de 13 de julho de 2017, trouxe uma alteração significativa na legislação inerente ao Direito do Trabalho. Com esta, além da modificação e inserção de diversos dispositivos legais, foi trazida, também, uma onda de insegurança jurídica por todo o país. Esta insegurança jurídica ocorreu não apenas do texto da nova lei como também da sua interpretação adotada pelos magistrados que a aplicaram. Sendo assim, buscando traçar um paralelo entre a Lei nº 13.467, de 13 de julho de 2017 e a posição dos magistrados, o presente trabalho visa ressaltar alguns pontos destacados pelos ilustres desembargadores do Tribunal Regional da 1ª Região (“TRT1”) quanto à Reforma Trabalhista antes e depois da sua entrada em vigor.

The Labor Reform, as Law Nº. 13,467 of July 13, 2017 is popularly known, brought a significant change in the labor legislation. This Law not only introduced various new legal provisions in the Labor Code, but also brought legal uncertainty throughout the country. This legal uncertainty occurred not only because of the language of the new law but also because of the interpretation adopted by the magistrates who applied it. Thus, seeking to draw a parallel between Law Nº 13,467 of July 13, 2017 and the position of magistrates, this paper aims to highlight some points raised by the distinguished judges of the Regional Court of the 1st Region (“TRT1”) regarding the Labor Reform before and after the law was enacted.
