Maternidade encarcerada: a persistência do padrão punitivista no TJSP frente ao HC 143.641

Abstract

O presente trabalho se propõe a investigar o impacto do precedente habeas corpus coletivo nº 143.41 do Supremo Tribunal Federal, de 2018, na atuação dos magistrados do Tribunal de Justiça do Estado de São Paulo, por meio da produção de um banco de dados referente às decisões proferidas nos sete meses que antecederam e que sucederam a concessão do HC pelo STF. O precedente refere-se à concessão do benefício da prisão domiciliar, em substituição à preventiva, previsto no artigo 318 do Código de Processo Penal brasileiro. O cruzamento de dados realizado na pesquisa intenta desvelar o padrão de respostas da magistratura às demandas das mães e gestantes presas preventivamente.

The present work intends to investigate the impact of the precedent of the Federal Supreme Court, the collective habeas corpus nº 143.41, judged in 2018, in the performance of the judges of the Court of Justice of the State of São Paulo, through the production of a database of decisions issued in the seven months preceding and succeeding the granting of the habeas by the Supreme Court. The precedent refers to the granting of the benefit of house arrest, replacing the pre-trial preventive custody, contained in article 318 of the Brazilian Code of Criminal Procedure. The cross-referencing of the data in the research tries to reveal the pattern of responses of the judges to the demands of mothers and pregnant women in preventive custody in Brazil
