La interpretación del negocio jurídico: problemas normativos y soluciones a la luz del código civil peruano

Abstract

La presente investigación constituye un análisis crítico de las normas de interpretación del negocio jurídico, contenido en el Libro Segundo del Código Civil vigente; esto es, partiendo de la problemática de la incoherencia y falta de unidad entre las normas civiles para una adecuada normatividad interpretativa del negocio jurídico, se llega a la conclusión de proponer la modificación de los artículos del referido cuerpo legal, en la parte pertinente.

Desde el punto de vista de la doctrina, se estudia los sistemas o teorías de la interpretación del negocio jurídico; y desde el punto de vista del derecho comparado, se observa la teoría o sistema interpretativo adoptado por los países; y finalizando con el análisis crítico de los artículos 168, 169 y 170 del Código Civil.

--- This research is a critical analysis of the rules of interpretation of the legal business, contained in the Second Book of the Civil Code, that is, starting from the problem of inconsistency and lack of unity among the civil rules for proper interpretation of regulations legal transaction is concluded to propose the amendment to the Articles of that body of law, in relevant part.

From the point of view of doctrine, we study systems or theories of interpretation of the legal business, and from the standpoint of comparative law, there is the theory or system of interpretation adopted by the countries, and ending with the critical analysis of Articles 168, 169 and 170 of the Civil Code.
