La Vacancia Presidencial por incapacidad moral Permanente y el Estado Constitucional de Derecho

Abstract

La presente tesis titulada “La Vacancia Presidencial por Incapacidad Moral Permanente y el Estado Constitucional de Derecho” tiene como objetivo general: Determinar cómo la falta de criterios para la Vacancia Presidencial afecta el Estado Constitucional de Derecho, para ello, se han desarrollado los conceptos de Vacancia Presidencial, Incapacidad Moral, Estado de Derecho, Juicio Político, Constitución Política del Perú. Esta investigación tiene una metodología cualitativa, debido a que en el proceso han brotado nuevas preguntas; es descriptiva, ya que se fundamenta en describir un problema determinado a partir de la investigación conseguida; tiene un diseño de exploración básico. La información recogida se recogió y se procesó utilizando un estudio de acción; así como las metodologías analítica, sintética, deductiva y la hermenéutica. Tipo de investigación exclusiva para un estudio cualitativo, pues se usa para procesar teorías sobre problemas distinguidos que se hallan en el contexto. La técnica de recolección de investigación ha sido aprobada por expertos, de índole de Derecho Constitucional. Por lo que, el propio se ha aplicado a 5 políticos escogidos por sus conocimientos y experiencias, teniendo como resultado que el Tribunal Constitucional al no haber resuelto e interpretado adecuadamente la figura de Incapacidad Moral Permanente, deja abierta esa puerta y podría generar inestabilidad política a cualquier mandatario, siendo un posible abuso al presidente que no cuente con votos mayoritarios por el congreso. Teniendo como conclusión que la carencia de criterios para la Vacancia Presidencial afecta el Estado Constitucional de Derecho.

The present thesis entitled "The Presidential Vacancy due to Permanent Moral Disability and the Constitutional State of Law" as its general objective: To determine how the lack of criteria for the Presidential Vacancy affects the Constitutional State of Law, for this, the concepts of Presidential Vacancy, Moral Disability, Rule of Law, Political Trial, Political Constitution of Peru. This research has a qualitative methodology, due to the fact that new questions have arisen in the process; it is descriptive, since it is based on describing a specific problem based on the research obtained; has a basic scan layout. The information collected was collected and processed using an action study; as well as analytical, synthetic, deductive and hermeneutic methodologies. An exclusive type of research for a qualitative study, as it is used to process theories about distinguished problems found in context. The research collection technique has been approved by experts, of a Constitutional Law nature. Therefore, it has been applied to 5 politicians chosen for their knowledge and experiences, with the result that the Constitutional Court, by not having resolved and adequately interpreted the figure of Permanent Moral Disability, leaves that door open and could generate political instability to any president, being impossible to abuse the president who does not have majority votes for the congress. Taking as a conclusion that the lack of criteria for the Presidential Vacancy affects the Constitutional State of Law.
