Ineficacia de acto de disposición de un bien social celebrado por uno de los cónyuges en Perú.

Abstract

En la presente tesis de investigación, aplicaremos la metodología utilizada en el trabajo de tesis que son el método inductivo-deductivo, el hermenéutico-jurídico y el método analítico-sintético; y también, las técnicas utilizadas son el acopio documental, la técnica de fichaje e interpretación normativa. La investigación que os presento trata sobre el caso particular de que, si la compraventa realizado por uno de los cónyuges de un bien social cuando esta no tiene poder especial, dicho acto jurídico deviene en una nulidad o ineficacia, esto debido a que existió un Pleno Nacional Jurisdiccional y un Pleno Casatorio Civil para referirse a dicho tema de investigación, por tanto, abordaré detalladamente las figuras de la Sociedad Conyugal, la representación de la Sociedad Conyugal, así como el Poder y la Compraventa.

In this research thesis, we will apply the method used in the thesis work, its inductive deductive, hermeneutic-legal and analytic-synthetic method; and also, the techniques used are the documentary collection, the signing technique and normative interpretation.
