dc.description.abstractFollowing research work is not a case at random or less a simple analysis of a legal provision or case in particular but is a legal proposal that tries to solve a social problem in the legal field in labor matters at the time of executing the ruling labor trials by the worker, to your employer by the compensation corresponding to right gives you the law, since it may exist that the situation of the employer change over the course of the labor trial and allow unsecured for the payment of the amounts corresponding to the worker. That's why, despite the new labor reforms, remains empty legal that fail to protect workers when to assert their rights and can collect the values that correspond to it, through the ruling established by the administrative authority legally dictated and driven justice according to what the Constitution because there are no measures that protect the right that corresponds to the worker who is the receive compensation that, by law, is due to the employer declares that it has with that solve the payment which the judge rules. And here is when the given problem that the situation of the employer can change since there are no guarantees or measures guaranteeing workers the right this suing in court, since the employer can establish a number of performances , that lead to their economic situation and their heritage to change by the fact there is no measures that protect, that this does not happen and thus ensure that it complies with values that must be met before the worker the benefit that this get when they had a relationship on contract. Used research techniques such as deductive and inductive methods, also the comparison, and hermeneutical methods applied documentary techniques, observation and finally the survey and interview different professionals and legal experts on the case to be investigated.
