dc.description.abstractThe work is based on the increase in negative impacts on the environment due to technological, scientific and social progress. The investigation uses the hypothesis, if the application of both civil and criminal sanctions to public and private companies will be able to control environmental pollution due to their activities. A critical and legal analysis focused on public and private companies was used through the bibliographic type methodology that became an operational strategy that allowed to observe and ii systematically reflect theoretical realities through the use of various types of documents such as texts, laws, codes, theories and concepts to establish the legal analysis, the study population is centered in the city of Cuenca where surveys and interviews were conducted with public officials and servants in charge of environmental protection, and with justice operators. It is concluded that environmental crimes that were committed and are committed by companies cause irreversible damage to the health and integrity of people also violate the rights of nature.
