La regulación administrativa del transporte terrestre, a la luz de la Constitución de la República del Ecuador

Abstract

The current legal system provides the mechanism in order to transfer the corresponding competencies to municipal and metropolitan GADS, as the Constitution provides. In addition, it also covers the mechanisms of regulation and administrative control of terrestrial transport, through an authorization certificate. Therefore this thesis develops a legal analysis, in the light of the Constitution, regarding the administrative regulation of terrestrial transport and thepowers acquired by a municipality.

For this investigation I have used the deductive method, based on the constitutional regulations related to the exercise of competencies transferred to the municipalities, so I could then consider the rules that are hierarchically lower. The technique used was the documentary, because it was supported by bodies of legislation and regulation, doctrinal and practical insights which have been obtained up to date.

The contribution to the development of Ecuadorian society is to be understood by virtue of all municipalitiesfully implement the relevant legislation system, in order to regulate theterrestrial transportation as an integral part of the good living of all citizens. I have investigated all forms of provision of the transportation service, modalities of transport, and the rights and obligations of the operators and users of transport; on the other hand, some law reforms have been argued due to the necessityof harmonizing the legislation system, as well as proposals for new legal standards in order to ensure quality service, all seenfrom a practical and legal point of view.
