dc.description.abstractJudge Dr. Santiago Altamirano made a query regarding the protection action presented by Dr. César Hernández Pazmiño, first judge of the Family, Women, Children and Adolescents of Esmeraldas, who was dismissed in 2013 for 'inexcusable error', after restoring one of its members for a lawsuit against the National Police. With the majority of the votes of the Constitutional Court, declared unconstitutional the decisions and administrative sanctions by the Council of the Judiciary typified and sanctioned in article 113 of the Organic Code of the Judicial Function, on the application of article 109 paragraph 7 dismissed judges by regarding 'inexcusable error' and 'manifest negligence'.
