Presidencialismo Populista Vs. Presidencialismo Deliberativo

Abstract

En el marco del análisis normativo de las falencias democráticas deliberativas de los sistemas presidenciales de gobierno, destacan dos incógnitas: 1) ¿es legítimo el sistema presidencial de gobierno en términos democráticos deliberativos? (enfoque ideal); y 2) ¿dado un sistema presidencial real qué arreglos constitucionales concretos deberían implementarse para que el mismo se acerque al cumplimiento del ideal democrático deliberativo? (enfoque no ideal). La primera de dichas incógnitas ha sido profusamente estudiada, mientras que la segunda no ha recibido suficiente atención. En primer lugar, desde un enfoque normativo ideal sostendremos que las objeciones democráticas dirigidas al sistema presidencial no son predicables de todo sistema presidencial de gobierno sino únicamente de aquellos que adoptan una concepción presidencial populista decisionista. Para ello señalaremos las falencias normativas de la concepción populista decisionista e identificaremos las ventajas de la concepción deliberativa neorepublicana. En segundo lugar, desde un enfoque normativo no ideal, indagaremos acerca de cuáles arreglos constitucionales podrían adoptarse para volver a los sistemas presidenciales más deliberativos.

In the context of analysis of the deliberative democratic shortcomings of the presidential systems of government, there are two main questions: 1) ¿is the presidential system of government legitimate in accordance with a deliberative democratic conception? (ideal approach); and 2) departing from a real presidential system ¿which specific constitutional arrangements should be implemented in it so that it comes close to meet the deliberative democratic ideal? (non ideal approach). The first of these questions has been widely studied, while the second has not received sufficient attention. First, from an ideal regulatory approach we will argue that the democratic objections addressed to the presidential system, are not predicable of all presidential system of government, but only of those that adopt a populist decisionist conception. In order to probe this thesis we will point out the shortcomings of the populist decisionist conception in comparison with the advantages neorepublican deliberative conception. Secondly, from a normative non ideal approach, this research will explore wich constitutional arrangements could be taken to turn presidential systems more deliberative.
