La cárcel del cabildo de Buenos Aires y sus fuentes: aproximaciones, problemas y potencialidades (1776-1821)

Abstract

El presente artículo se propone trazar un bosquejo del corpus de fuentes documentales conservadas al día de hoy sobre la cárcel que se situaba en el cabildo de Buenos Aires. Nuestra intención será dar cuenta de las limitaciones y potencialidades de dichas fuentes, y al mismo tiempo hacer un recorrido por las aproximaciones historiográficas que se valieron de las mismas. Eledificio del cabildo se construyó a inicios del siglo XVII en la plaza mayor, y desde el inicio contuvo calabozos para custodiar a sospechosos de haber cometido faltas y crímenes. En años posteriores se construyeron nuevas celdas, e incluso la cárcel sobrevivió a la disolución del cabildo como institución en 1821, para finalmente transferir sus funciones a la penitenciaría creada en 1877. En este trabajo, nuestras apreciaciones sobre la cárcel porteña como objeto de estudio y sus fuentes mayoritariamente versarán sobre los años virreinales y la primera década revolucionaria. Analizaremos básicamente siete tipos de fuentes:leyes, doctrina, actas capitulares, archivo del cabildo, libros de visitas de cárcel, solicitudes de presos y expedientes judiciales.

The present article intends to draw up an overview of the documentary sources which are preserved about the prison located in the town hall of Buenos Aires. Our intention will be to account for the limitations and potentialities of these sources, and at the same time analize the historiographic approaches that used them. The building of the cabildo was constructed at the beginning of seventeenth century in the main square, and from the beginning it contained dungeons to guard suspected of committing misdemeanors and crimes. In later years new cells were built, and after that the prison even survived the dissolution of the cabildo as an institution in 1821, to finally transfer its functions to the penitentiary created in 1877. In this paper, our considerations on the Buenos Aires jail as matter of investigation and its sources will mainly deal within the viceregal years, and the first revolutionary decade. We will analyze basically seven different types of sources: laws, doctrine, records and archives of the council town, jail visit books, prisoners requests, and judicial files.
