| dc.description | Introdução: A judicialização da saúde é compreendida como ferramenta social, sendo um
espaço vasto e amplo de reclame de bens e serviços garantidos por direito. O fenômeno
envolve aspectos políticos, sociais, éticos e sanitários. Em meio a sua complexidade e às
dificuldades de construção de um sistema nacional de caráter universal em um país
heterogêneo e desigual, persistem desafios relacionados aos problemas estruturais do sistema
de saúde brasileiro.Objetivo:Caracterizar a judicialização da saúde no estado de Pernambuco,
em 2016.Metodologia: Foi desenvolvido um estudo descritivo de abordagem quantitativa. A
descrição do perfil dos processos foi realizada segundo sexo e residência. Para a
caracterização das ações foram definidas as seguintes categorias e sub categorias: (i)Bem
demandado: Alimento; Equipamento; Insumos; Medicamentos; e Procedimentos; (ii) Grupo
CID 10; e (iii) Unidade demandante.Resultados:Foram registradas 2.562 ações judiciais no
Estado.Dessas, (42,7%) originou-se de residentes da I GERES que é formada por municípios
desenvolvidos. Em relação ao sexo dos, a maioria foram do sexo feminino (37,5%), destacase o alto percentual de sexo ignorado (26,3%). Identificou-se que as maiorias das ações
referiram-se a medicamentos (64,4%) e (27,9%) no tratamento das neoplasias. Das ações
movidas contra o Estado no ano 95% delas foram deferidas em favor do requerente.
Conclusão:A judicialização da saúde pode se configurar como mecanismo de reivindicação
do direito à saúde estando a serviço do usuário, mas pode ser direcionada ao mercado, ao
consumo ao direito individual, ferindo o princípio da equidade. | |
| dc.description | Introduction: The judicialization of health is understood as a social tool, being a vast and
wide space for claiming goods and services guaranteed by law. The phenomenon involves
political, social, ethical and sanitary aspects. In the midst of its complexity and the difficulties
of building a national system of universal character in a heterogeneous and unequal country,
challenges remain related to the structural problems of the Brazilian health system. Objective:
To characterize the judicialization of health in the state of Pernambuco, in 2016.
Methodology: A descriptive study of quantitative approach was developed. The profile of the
processes was described according to sex and residence. For the characterization of the
actions the following categories and sub categories were defined: (i) Well demanded: Food;
Equipment; Inputs; Medicines; and Procedures; (ii) CID Group 10 and the applicant unit.
Results: 2,562 lawsuits were registered in the State. Of these, (42.7%) originated from
residents of I GERES which is formed by developed municipalities. Regarding the sex of the
patients, the majority were female (37.5%), the high percentage of sex ignored (26.3%) stands
out. It was identified that most of the actions referred to medications (64.4%) and (27.9%) in
the treatment of neoplasias. Of the actions brought against the State in the year 95% of them
were deferred in favor of the applicant. Conclusion: The thematic can be configured as a
mechanism for claiming the right to health being at the service of the user, but can be directed
to the market, to consumption to the individual right, violating the principle of equity. | |
