O Realismo Jurídico norte-americano foi a corrente teórica escolhida, por preocupar-se com a análise dos meios e caminhos que os juízes utilizam na tomada de uma decisão jurídica, para atender a realidade social. A corrente formalista, que havia se consolidado sob uma perspectiva liberal durante o século XIX, mostrava-se ineficiente, para atender as novas demandas da sociedade. Assim, nosso objeto de estudo será verificar a importância do realismo jurídico de Benjamim Nathan Cardozo, a fim de auxiliar na compreensão que, para uma decisão ser justa, é preciso que o magistrado se preocupe mais com a realidade social e o atendimento à ordem jurídica fundamentada no bem-estar social do que com a letra fria da lei. Esse trabalho volta-se a avaliar uma possibilidade de interpretação das decisões da Justiça do Trabalho em suas três instâncias, tendo como escolha os litígios que versavam sobre a questão do trabalho análogo a condição de escravo, isto porque o representante adotado do Realismo Jurídico norte-americano destacava em seus julgados o comprometimento de se atingir na busca da “justiça social”, vertente predominante da Justiça do Trabalho brasileira. Diante disto, é momento de refletir o modelo institucional do Poder Judiciário aplicado no Brasil, visando a encontrar alternativas mais adequadas à realidade nacional, construir uma opinião pública e descobrir as soluções, a fim de converter o atraso em modernização jurídica.CAPESThe concern with judicial decisions in Brazil has led jurists to reflect on the ways of interpreting Law in an attempt to understand the existing and attributable reality in the legal environment. US legal realism was the chosen theoretical current because it’s main concern is analize the means and ways used by judges to make a juridical decision in order to attend social reality. The formalist current, which had consolidated under a liberal perspective during the nineteenth century, was inefficient to meet the new demands of society. Thus, our object of study will be to verify the importance of the legal realism of Benjamin Nathan Cardozo, in order to help the comprehension that for a decision to be fair, it is necessary the magistrate to be more concerned with the social reality and the service to the legal order based on social welfare than on the cool letter of the law. This paper examines a possibility of interpreting the decisions of the Labor Court in its three instances, choosing cases that dealt with labour analogous to slavery, because the adopted representative of legal realism, in its judgements, stressed the commitment of reaching in the pursuit of "social justice", predominant slope of the Brazilian Labor Justice. Therefore, it is time to reflect the institutional model of the Judiciary Power applied in Brazil, aiming to find alternatives more appropriate to the national reality, build a public opinion and discover the solutions, in order to convert the delay in legal modernization.
