CASTRO JÚNIOR, Torquato da Silva, também é conhecido(a) em citações bibliográficas por: CASTRO JR., Torquato da Silva ; COSTA E SILVA, Gustavo Just da, também é conhecido(a) em citações bibliográficas por: JUST, Gustavo O presente trabalho examina, de uma perspectiva observacional, o raciocínio estratégico e a argumentação em torno das escolhas interpretativas nas decisões proferidas pelo Supremo Tribunal Federal que julgaram, de maneiras opostas – respectivamente, pela concessão e pela denegação da ordem –, os habeas corpus de nº 84.078 e nº 126.292, enfrentando a questão da possibilidade de cumprimento antecipado da pena privativa de liberdade após a confirmação da condenação em segunda instância julgadora e, portanto, antes do trânsito em julgado da sentença, apesar da proibição do art. 5º, LVII, da Constituição Federal de 1988, que estabelece o princípio da presunção de inocência entre nós. Partimos da premissa, formulada por Gustavo Just, de que as decisões interpretativas são discursos orientados à objetividade, os quais têm a pretensão de se apresentarem, justificarem-se e perceberem-se como o resultado de critérios neutros e impessoais, e não como a expressão da arbitrariedade ou das preferências subjetivas do julgador. Investigamos a hipótese de que toda escolha interpretativa tem um impacto na persuasão e na objetividade da decisão que está sendo proferida e, também, um reflexo potencial sobre o poder do intérprete na prolação de futuras decisões; em consequência, um dos fatores de influência das escolhas interpretativas é o raciocínio estratégico que pondera os benefícios e sacrifícios (institucionais) de determinada decisão. A análise das decisões concentra-se em dois níveis de recursos discursivos empregados pelos juristas com o fito de se desincumbirem de seu compromisso para com a retórica da objetividade: a justificação da decisão interpretativa, mediante o emprego de formas argumentativas aceitas na comunidade jurídica como aptas a fundamentar escolhas interpretativas; e a invocação de argumentos não “codificados” pela cultura jurídica, como aqueles encontrados na literatura filosófica, política ou econômica. O caráter irregular (e em grande medida caótico) das estruturas argumentativas concretamente empregadas indica que o discurso judicial brasileiro é marcado pela pessoalidade e por uma estrutura de agregação de opiniões, e não por uma racionalidade institucional; entretanto, essa constatação é insuficiente para se concluir pela inexistência do direito brasileiro como um campo social diferenciado e autônomo, pois esse arranjo institucional apresenta relativa funcionalidade e os discursos jurídicos nele produzidos mantêm o compromisso com a retórica da objetividade, ainda que não atendam às exigências de modelos normativos pensados em tradições estrangeiras. Constata-se nas decisões coletadas que esse raciocínio estratégico orientado à objetividade se expressa (1) no relativo prestígio que possuem os métodos clássicos de interpretação (especialmente o gramatical e o sistemático), a despeito das fortes críticas que lhe são feitas no plano teórico; (2) na utilização fluida dos princípios jurídicos, sem apego aos esforços metodologizantes das teorias pós-positivistas, e; (3) no emprego, por vezes, comedido (e com função meramente ornamental) da argumentação não juridicamente codificada, mas por outras, ao revés, incisivo, persuasivo e com vistas a reforçar uma argumentação consequencialista. The present work examines, from an observational perspective, the strategic reasoning and the argumentation about the interpretative choices in the decisions pronounced by the Supremo Tribunal Federal, which judged, in opposite ways – respectively, by the concession and the denial of the order –, habeas corpus number 84.078 and 126.292, facing the question of the possibility of early execution of the custodial sentence after confirmation of the conviction in the second court and, therefore, before the sentence of res judicata, despite the prohibition of art. 5, LVII, of the Federal Constitution of 1988, which establishes the principle of presumption of innocence among us. We start from the premise formulated by Gustavo Just that interpretative decisions are objectivity-oriented discourses, which are intended to present themselves, to justify themselves and to perceive themselves as the result of neutral and impersonal criteria, and not as the expression arbitrariness or subjective preferences of the judge. We investigate the hypothesis that all interpretive choices have an impact on the persuasion and objectivity of the decision being made and also a potential reflection on the power of the interpreter in the rendering of future decisions; consequently, one of the influencing factors of the interpretive choices is the strategic reasoning that weighs the benefits and sacrifices (institutional) of a given decision. The analysis of decisions focuses on two levels of discursive resources used by jurists in order to disclose their commitment to the rhetoric of objectivity: justification of the interpretative decision, using argumentative forms accepted in the legal community as apt to support interpretive choices; and the invocation of arguments not "codified" by legal culture, such as those found in philosophical, political or economic literature. The irregular (and largely chaotic) character of the argumentative structures concretely employed indicates that the Brazilian judicial discourse is marked by personalities and by a structure of aggregation of opinions, not by an institutional rationality; however, this finding is insufficient to conclude that Brazilian law does not exist as a differentiated and autonomous social field, since this institutional arrangement presents relative functionality and the legal discourses produced in it maintain the commitment to the rhetoric of objectivity, even though they do not meet the requirements of normative models thought of in foreign traditions. It can be seen from the collected decisions that this strategic reasoning oriented to objectivity is expressed (1) in the relative prestige of the classical methods of interpretation (especially grammatical and systematic), despite the strong criticisms made on the theoretical plane; (2) in the fluid use of legal principles, without attachment to the methodological efforts of post-positivist theories; (3) in the employment, at times, of a restraint (and with a merely ornamental function) of non-juridically codified argumentation, but by others, on the contrary, incisive, persuasive and with a view to reinforcing consequentialist argumentation.
