O presente trabalho objetivou colher evidências empíricas no tocante ao desempenho da indústria fonográfica brasileira diante das múltiplas facetas da pirataria musical e do surgimento de novos modelos de negociação. Além disso, este estudo visou reduzir os efeitos negativos da pirataria musical sobre as empresas envolvidas nesse segmento de mercado e comprovar oportunidades de surgimento de novos modelos de negociação, à luz da Nova Economia Institucional. Trata-se de uma pesquisa exploratória, bibliográfica, de abordagem histórico-qualitativa. Observou-se que os efeitos da pirataria vão muito além das implicações jurídicas dessa prática social, cumprindo também uma função de mediadora cultural, no processo de divulgação e ensejando novas formas e/ou modelos de negociação. Constatou-se, também, a relação do mercado pirata com a emergência e consolidação do cenário musical regional, destacando-se o tecnobrega, a música sertaneja do interior, o sertanejo universitário, além da associação ao agribusiness, circuitos de shows e rodeios, e festas agropecuárias.This study aimed to gather empirical evidence regarding the performance of the Brazilian music industry on the many facets of music piracy and the emergence of new models of talks aimed at reducing the negative effects the piracy on the companies involved in this market segment and the opportunity to rise new trading models in the light of the New Institutional Economics. This is an exploratory research, bibliographic, of historical approach qualitative. It is observed that the effects of piracy go well beyond the legal implications of this social practice, also fulfilling a function of cultural mediator in the process of disclosure and entailing new forms and / or trading models. Observes-if that the pirate market is associated with emergency and consolidation of the regional music scene, standing out the technobrega, the country music of the interior, the backcountry university, in addition to the association agribusiness, circuits shows and rodeos, and livestock festivals.
