Resumen
Celebrated by some and criticized by others, the stare decisis system adopted by the
Brazilian procedural law is, undoubtedly, one of the most important innovations of this
procedural statute. Even if it is possible to affirm that the judges were already forced to
follow precedents, it is undeniable that with the advent of the new statute the system was
valued, expanded and improved. In view of the relevance that the theme has acquired in
our procedural order, it is necessary to analyze its relationship and its compatibility with
the current evolutionary stage of the Science of Law, more specifically with contemporary
constitutionalism and with the actual notions of procedural democracy, which require that
the jurisdictional function be exercised in a democratically legitimate manner. Only then
will be possible to conclude about the necessity or the convenience of the existence of a
system of binding precedents in the Brazilian legal order, traditionally affiliated to the
civil law. As well known, post-positivist dictates have renewed the Science of Law. In
order to understand this current context, it is necessary to do a critical and historical
analysis about the process of formation of the Rule of Law, from the decline of
Absolutism to the present, highlighting some of the main aspects of liberal, social and
contemporary constitutionalism, its positive and negative points, which will justify the
desired conclusion. Among the most relevant features of the current stage, it highlights
the expansion and fortification of the Judiciary, and the hermeneutic opening provided by
the understanding of the distinction between text and norm and by the understanding that
all interpretive activity is also creative. In this context, is essential to study the democratic
legitimacy of the jurisdictional function. The purpose here is to establish the means by
the jurisdiction can be exercised in a democratic way, that the contemporary times
demands. And one of the main aspects capable to democratize judicial acts, including
decisions, is a procedural law that resizes some of the main corollaries of due process of
law and access to justice, like the motivation, the publicity and the contradictory. In this
way, a judicial process, appropriated to the premises of contemporary constitutionalism
must be structured in a dialogic way that guarantee effectiveness and balance in the
participation and in the distribution of rights, duties and procedural burdens among all the
participants and interested in the process result. However, the system of binding
precedents adopted by the Brazilian procedural statute has been criticized in cause of a
possible incompatibility of its institutes and techniques with the premises of
contemporary constitutionalism and with a democratically judicial process. In this
context, the present study will analyze the relation between the binding precedents, the
contemporary constitutionalism and the democratic principle applicable to the civil
process, to conclude about the necessity or the convenience of a stare decisis system o in
our juridical order. Festejado por alguns e criticado por outros, o sistema de precedentes vinculantes previsto
Código de Processo Civil brasileiro é, sem dúvidas, uma das grandes inovações desse
diploma processual. Ainda que seja possível afirmar que a obrigação dos magistrados das
instâncias inferiores em seguir precedentes já existia, é inegável que com o advento da
nova codificação o sistema foi valorizado, ampliado e aprimorado. Diante da relevância
que o tema adquiriu em nossa ordem processual, faz-se necessário analisar a sua relação
e a sua compatibilidade com o atual estágio evolutivo da Ciência Jurídica, mais
especificamente com o constitucionalismo contemporâneo e com as hodiernas noções de
democracia processual, que exigem que a função jurisdicional seja exercida de maneira
democraticamente legítima. Somente assim será possível concluir sobre a necessidade ou
a conveniência da existência de um sistema de precedentes vinculantes no ordenamento
jurídico brasileiro, tradicionalmente filiado à civil law. Desse modo, fundamental é
compreender a renovação que os ditames pós-positivistas têm provocado na Ciência
Jurídica. Para bem entender o contexto atualmente vivenciado, faz-se preciso realizar uma
análise histórico-evolutiva – e crítica – do processo de formação do Estado de Direito,
desde o declínio do Absolutismo Monárquico até o atual Estado Constitucional,
destacando-se alguns dos principais aspectos do constitucionalismo liberal, do social e do
contemporâneo, seus pontos positivos e negativos, que servirão de base para a conclusão
almejada. Dentre as características mais relevantes da fase atual, destacam-se a expansão
e o fortalecimento do Poder Judiciário, e a abertura hermenêutica propiciada pela
compreensão da distinção entre texto e norma e pelo entendimento de que toda atividade
interpretativa é, em certa medida, criativa. Nesse contexto, revela-se fundamental estudar
a legitimidade democrática da função jurisdicional. O objetivo nesse ponto é estabelecer
os meios através dos quais a jurisdição pode ser exercida em conformidade com as
exigências democráticas da contemporaneidade. E um dos principais aspectos capazes de
legitimar democraticamente os atos judiciais, inclusive as decisões, é um direito
processual que redimensione alguns dos principais corolários do devido processo legal e
do acesso à justiça, tais como a fundamentação das decisões, a publicidade e o
contraditório. Nesse sentido, um processo judicial adequado às premissas do
constitucionalismo contemporâneo deve ser estruturado com ferramentas dialógicas, que
garantam efetividade e equilíbrio na participação e na distribuição dos direitos, deveres e
ônus processuais entre todos os sujeitos participantes e interessados no resultado do
processo. Acontece que o sistema de precedentes vinculantes adotado pelo Código de
Processo Civil brasileiro tem sido alvo de algumas críticas referentes a uma possível
incompatibilidade de seus institutos e técnicas com as premissas do constitucionalismo
contemporâneo e com um processo civil democraticamente estruturado. É nesse contexto
que o presente trabalho analisará a relação entre os precedentes obrigatórios, o
constitucionalismo contemporâneo e o princípio democrático aplicável ao processo civil,
para que se possa concluir acerca da necessidade e da conveniência de um sistema de
precedentes obrigatórios em nosso ordenamento jurídico. 2021-08-15
