Resumen
This project addresses the issue of effectiveness compensation for affective abandonment from a psychological point view. Examining the concept civil responsibility and affective abandonment in the Brazilian legal system, pointing out how, from a psycho-emotional point view, decisions on this subject are treated Superior Court of Justice within the scope, from the conflict resolution perspective. Considering the constitutional right to guarantee to children, adolescents and young people, among others, dignity, respect, family and community coexistence, in addition to protection from negligence, discrimination and cruelty. The absence of specific legislation that attends the particularities regarding accountability for affective abandonment is evident. Is indemnification the right way to account for emotional abandonment? Will compensation resolve the consequences brought about by emotional abandonment from a psychological perspective? Therefore, it aims to discuss the current understanding in judicial decisions regarding civil liability due to affective abandonment, as well as its practical consequences in the light of Psychology. The methodology adopted consists of bibliographic and documentary research, using systematic review and narrative review as procedures between the years 2017 to 2021, adopting a qualitative approach. From the research carried out, it can be concluded that there should be interdisciplinary studies, with specialists in the psychological, sociological, pedagogical, legal areas, among others, to find solutions to such a complex issue as affective abandonment.
