O papel das súmulas na consolidação da jurisprudência trabalhista

Abstract

The present work aims to analyze and identify the role of labor precedents. For this purpose, it iniates from the general context of the origin of precedents in national law with a more specific analysis about labor law, addressing its characteristics, and procedures for editing, revision and cancellation. It is also approached the filling of gaps and identification of these as a source of law. The methodology used in the present investigation consists in a deductive and qualitative method of approach, carried out through bibliographic research, using doctrine, legislation and jurisprudence on the subject as a source. It was concluded that the labor precedents condenses the prevailing understanding in a Superior Labor Court, promoting the pacification of similar demands and generating legal security and social peace in the labor field. And, finally, the labor precedent promotes normativity and protection to the worker who is inserted within contexts not regulated by Law, in conditions impossible to wait for the legislative activity.
