Abandono afetivo sob a ótica do direito sistêmico: uso das constelações familiares

Abstract

The objective of this work is to analyze whether the use of family constellation, a therapeutic method developed by Bert Hellinger, can be applied in cases of emotional neglect, offering more effective solutions, based on a more humanized justice developed by Systemic Law. In this sense, we sought to understand how the emotional neglect is configured, and how the subject was approached in the doctrine and jurisprudence of the Brazilian courts and if it is possible to apply the Hellinger method. The methodology used consists of bibliographic research, in addition to a descriptive and qualitative approach, with analysis of books, scientific articles, normative texts, lectures and videos on the subject. It also uses the logical-deductive method to analyze information about the use of the family constellation in practice, through projects developed in courts, in connection with the application in cases of abandonment. It is concluded that the use of the family constellation has no proven effectiveness, but the systemic technique has been growing more and more, being used not only by judges, but also by lawyers and other law enforcers. In addition, some published studies demonstrate that the Hellinger method facilitates the conclusion of agreements in the judicial or extrajudicial sphere. This is why it is suggested in this work as a method that can be used in cases of emotional neglect, offering a deeper approach to conflict.
