dc.description.abstract | The reference to the paradigm of consciousness as a condition for responsibility as the source
of our choices and actions leads to the admission of procedures of argumentation that leads us
to reach the point of view of the other. With this, there would be an application of the
categorical imperative which, by Habermas's interpretation, would have its full realization in a
predominantly discursive rather than individual (moral) reason. In this sense, the referential
character of language is indispensable and inseparable from the concept of knowledge as
representation, truth as correspondence to facts. Habermas departs from effective social
relations and distinguishes between the action of strategic speech whose reference to reality
can be false and the action of communicative speech, in which this reference aims to
communicate the reality in question. However, the ethics of discourse is only effective for the
situation of maximum discursive equality possible by the willingness to co-ordinate the goals
and institutes. A specific case is shown by the technocracy that, as Habermas notes, appears in
the current scenario as an urgent theme. The decisionism of the acts of will of specialists
should be in consonance to the pragmatics of the reciprocal communication. To contemplate
this discussion uses productions of authors like Habermas, Moreira and Gisele Citadino who
defend the popular sovereignty as guarantor of the political pragmatics. Alexy and Botelho
diverge from these, in turn, defending, in counterpoint, a position of judicial activism. Carlos
Augusto Ali Amim points out the ever present risk in the courts of confusing the deontology
of the norms with the teleology of values as will be approached in the last article / section of
this dissertation. The present work deals with a bibliographic, documentary, explanatory and
qualitative research. In this context, there are potential problems between national States,
Regions and people for claims incompatible with the reality referred to by the speech. Not
always that a speech may be appropriate to existing institutes, it is being a true / ethical
discourse. The search here would therefore be by the criterion by which a discourse is ethical. | |
