Regulação das Loot Boxes e os jogos de azar no Brasil

Abstract

This work deals with the legal relationship of Loot Boxes, compared to games of chance and their respective implications. In this context, issues related to the legalization and regulation of games of chance and, consequently, of Loot Boxes will be discussed, in order to work on the issues relevant to the theme. This study is relevant considering that in the information society in which we operate, a large portion of individuals play video games, being a market that moves billions of reais every year and that needs to protect the player against possible abuse. The difficulties found in the development of the research resided in the scarcity of specific bibliography on the subject, as well as the little importance given to this problem in the scope of the judiciary, doctrine and jurisprudence. The methodology used consists of applied research, with a hypothetical-deductive, qualitative and quantitative approach, with an exploratory objective and the purpose of proposing plans. It is concluded that the subject deserves further legislative discussion so that it moves towards legalization and regulation both with regard to games of chance and in Loot Boxes, and related issues depend on the one to be regulated.
