Resumen
This monograph discusses the collective moral damages produced by the placement of misleading advertising in electronic commerce. Issues related to misleading advertising on marketplace platforms and their resulting civil liability will be addressed. This work was based on the consideration that there are still many doubts about the classification of the respective civil liability, notably regarding the form of verification of guilt and the disposition on which subjects can be held responsible. It was also verified whether such responsibility will occur objectively or subjectively, on which subjects of the consumption relationship it will fall, whether it will be solidary or subsidiary and also who will be the affected consumers. The methodology used consists of applied research, with a hypothetical-deductive and qualitative approach, with a descriptive objective. Finally, it was concluded that civil liability for misleading advertising is objective and joint between the seller and the marketplace platform.
