Resumen
This dissertation it aims to investigate the relationship between the right to silence provided
for in art. 5, LXIII, the Brazilian Federal Constitution and the prediction of waiver of that
right brought with the plea arrangement institute, more precisely on the article 4, § 14 of Law
12,850/2013, verifying any state's evidence. In order to achieve the objective, it is taken from
the constitutional process of fundamental rights, from the 2nd World War, with visits to some
of supported theories. Organized crime phenomenon also goes by the study, as the plea
arrangement institute tool was created to provide the criminal prosecution bodies of the means
of obtaining evidence. The methodological and legal support work will be in the Liberal
Theory of Fundamental Rights, so that will be studied dogmatic of such a theory, by which
the constitutionality of the waiver of the right to silence under the plea arrangement institute,
will be examined in the context of growing development of criminal organizations, need to
equip the state to combat organized crime instruments, parallel to the necessary respect for
fundamental rights and limits on government intervention in the individual sphere.
